[스포츠한국 이재호 기자] 이른바 '날강두' 사태를 만들었던 친선전 주최사인 더페스타가 "자신들에게 모든 책임이 주어지는건 과도하다"고 변론했다.

서울중앙지법 민사합의21부(김상훈 부장판사) 심리로 9일 손해배상 청구 소송 첫 변론기일이 열렸다.

이날 열린 재판은 티켓 구매자 5천여명이 더 페스타를 상대로 낸 15억여원 규모의 집단소송이다.

더페스타 측 변호인은 "티켓 판매는 행사 대행사인 더페스타가 아닌 소비자와 티켓판매대행사 사이에 이뤄진 것"이라고 주장했다. "법리적으로 놓고 보면 소비자들의 계약 상대는 더페스타가 아닌 티켓판매대행사이므로 책임이 과도하다"고 했다.

지난해 7월 26일 서울월드컵경기장에서는 이탈리아 유벤투스와 K리그 올스타팀의 친선전이 있었다. 하지만 45분 출전할 것이라고 기대됐던 크리스티아누 호날두는 끝내 출전하지 않았고 경기시간도 늦춰지는 등 대국민 해프닝으로 큰 논란이 됐었다.

더페스타 측 변호인은 이날 재판 후 취재진에 "만약 호날두만 출전하고 다른 유벤투스 선수들이 한 명도 나오지 않았다면 그것도 계약 불이행인가"라며 "'호날두 45분 출전'은 더페스타가 먼저 광고한 것도 아니다"라고 말했다.
